1. General
These Terms & Conditions apply to all purchases and use of www.ninedrink.dk, operated by Drink ApS (CVR registration available on request), Ehlersvej 7, 2900 Hellerup, Denmark ("Nine", "we", "us").
By placing an order or using our website, you agree to these terms. If you do not agree, please do not use the site or place an order.
2. Products
nine™ is a functional nootropic drink available in multiple flavours. Product information, including ingredients and nutritional details, is published on our ingredients page and on product labels.
Our products contain caffeine and other active ingredients. They are not recommended for children, or pregnant or breastfeeding women. Fresh Lemon is marketed as a food supplement; White Peach as a vitamin drink. A food supplement should not replace a varied diet.
Product images on the website are illustrative. Minor variations in packaging or appearance may occur.
3. Pricing & payment
All prices are displayed in Danish kroner (DKK) and include VAT unless clearly stated otherwise. Shipping costs, if any, are shown at checkout before you complete your order.
We reserve the right to correct pricing errors, typographical mistakes, or inventory discrepancies. If an error affects your order, we will contact you and offer to cancel or amend the order.
Payment is processed securely via the methods available at checkout, including card payments, MobilePay, Klarna, and Shop Pay.
4. Orders & contract
Your order constitutes an offer to purchase. A binding contract is formed when we send your order confirmation email. We reserve the right to refuse or cancel orders in cases of payment failure, suspected fraud, stock unavailability, or errors in pricing or product information.
5. Delivery
Delivery terms are described in our Shipping policy. Standard delivery within Denmark is 1–3 business days after dispatch via GLS. Risk of loss passes to you upon delivery to the address you provided.
6. Right of withdrawal & returns
As a consumer in the EU, you have a 14-day right of withdrawal from the day you receive your goods. Full details, including how to return products and our 30-day satisfaction guarantee, are set out in our Returns policy.
Returned products must be in substantially the same condition and quantity as received. You are responsible for return shipping costs unless otherwise stated.
7. Complaints & defects
If you receive a defective or damaged product, please contact us at info@ninedrink.dk within a reasonable time. We will remedy the issue in accordance with applicable Danish consumer protection law.
8. Subscription orders
If you subscribe to recurring deliveries, you may pause, skip, or cancel your subscription at any time through your account or by contacting us. Subscription pricing and frequency are confirmed at checkout.
9. Intellectual property
All content on ninedrink.dk — including text, graphics, logos, images, and design — is owned by Drink ApS or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or use our content without prior written consent.
10. Limitation of liability
We are liable for direct losses caused by our breach of these terms or negligence, to the extent permitted by Danish law. We are not liable for indirect or consequential losses. Nothing in these terms limits your statutory rights as a consumer under mandatory Danish or EU law.
11. Privacy
Your use of the website and any order you place is also governed by our Privacy & Cookie Policy.
12. Governing law & disputes
These terms are governed by Danish law. Disputes shall be submitted to the courts of Denmark, unless mandatory consumer protection rules require otherwise.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes
We may update these terms from time to time. The version published on this page at the time of your order applies to that purchase.
